Terms and Conditions

By placing an order, the Buyer fully accepts the regulations. If the Buyer has any comments or reservations regarding the provisions of the regulations and wishes to define them in a different way, the Buyer should refrain from placing the order and send a modification proposal to the following address: info@sunngin.com. This does not apply to the scope of the Seller's business or specific prices of products or services.

  1. Definitions

The delivery price list is specified and publicly available at www.sunngin.com

Delivery - the type of transport service along with the cost can be found at www.sunngin.com

Customer – an adult natural person with full legal capacity, a legal person or an organizational unit without legal personality but with legal capacity, making a purchase from the Seller directly related to its business or professional activity.

Product card – a single subpage of the store providing information about a given product.

Consumer – an adult natural person with full legal capacity, making a purchase from the Seller that is not directly related to his or her business or professional activity.

Buyer – Consumer and Customer

Basket – a list of products ordered by the Buyer in the Seller's product store.

Place of delivery of the item - collection point or postal address indicated by the buyer in the order form.

Collection point - the place of delivery of the goods, other than a postal address, indicated by the Buyer to the Seller as the place of delivery.

Time of delivery of the item - the moment at which the Buyer or a third party acting on his behalf takes possession of the item.

Payment – ​​method of payment for the subject of the contract along with delivery.

Product – the minimum and non-divisible quantity of items that constitute the subject of the order, given in the Seller's store as a unit of measurement when determining its price.

Subject of the contract – products and delivery that are the subject of the contract.

Store – online service available at www.sunngin.com , through which the Buyer can place an order.

Order - a declaration of will by the Buyer submitted via the store, clearly specifying the type and quantity of products, type of delivery, type of payment, place of delivery of the item, and the Buyer's data aimed at concluding a contract between the Buyer and the Seller.

Defect – a physical and legal defect.

A physical defect is the non-compliance of the sold item with the contract:

 

– lack of properties, the existence of which the Seller informed the Buyer,

 

– it is not suitable for the purpose about which the Seller informed the Buyer when concluding the contract,

 

– it does not have properties that it should have due to the purpose specified in the contract, resulting from its intended use,

 

– was delivered to the Buyer incomplete.

 

A legal defect is a situation in which the subject of sale is the property of a third party or is encumbered with the rights of a third party, as well as if the restriction on the use or disposal of the item results from a decision or ruling of a competent authority.

 

  1. General conditions

The contract is concluded in Polish, in accordance with Polish law and these regulations.

The place of delivery of the goods must be in the territory of the Republic of Poland.

The Seller is obliged to provide services and deliver items free from defects to the Buyer.

All prices provided by the Seller are expressed in Polish currency (PLN) and are gross prices (including VAT).

All deadlines are calculated in accordance with Art. 111 of the Civil Code, i.e. a period specified in days ends on the expiry of the last day, and if the beginning of a period specified in days is a certain event, the day on which this event occurred is not taken into account when calculating the period.

The buyer may choose to have his/her data remembered by the store to facilitate the process of placing another order. For this purpose, the Buyer should provide the login and password necessary to gain access to his account. The login and password are a sequence of characters set by the Buyer, who is obliged to keep them secret and protect them against unauthorized access by third parties. Buyers can view, correct, update data and delete their account in the store at any time.

The buyer is obliged to:

not providing or transmitting content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,

not to take actions such as: sending or posting unsolicited commercial information in the store (spam),

use the store in a way that is not inconvenient for other Buyers and the Seller,

use the store in a way that does not interfere with its operation, in particular through the use of specific software or devices,

use all content posted in the store only for your own personal use,

use the store in a manner consistent with the provisions of applicable law in the territory of the Republic of Poland, the provisions of the regulations, as well as the general principles of net etiquette.

  1. Conclusion of the contract and delivery

Orders can be placed 24 hours a day.

The order must be placed at least 2 (two) business days before the date of planned delivery of the order.

In order to place an order, the Buyer should perform at least the following steps, some of which may be repeated many times:

adding a product to the cart;

choosing the type of delivery;

selection of payment type;

choosing the place to hand over the items;

placing an order in the store by using the "Order and pay" button.

Placing an order is tantamount to concluding a contract with content analogous to the content of these regulations, detailed with the provisions contained in the order confirmation sent electronically to the Buyer.

Product prices are specified in the price list available on the store's website www.sunngin.com.

 

The order may be processed no earlier than 48 (forty-eight) hours from the moment it is placed by the Buyer and the order is confirmed by the store, and if the Buyer chooses the transfer payment option, additionally after the payment has been credited to the Seller's bank account or the Buyer has received confirmation of the transfer or if the Buyer chooses the payment option via PayU account from the date of receipt of the payment by the Seller.

 

The Seller adheres to the selected delivery time period, but the Buyer should bear in mind that the driver may be at the Buyer's place at a different time every day - of course, within this time range. In the case of the delivery address provided by the Buyer, which does not include deliveries on weekends and non-working days, the Seller reserves the right to make the delivery at another time on the business day covered by the possibility of delivery or to deliver the order on Saturday to the parcel locker indicated by the Buyer, after previously agreeing on a change of date and method. delivery with the Buyer.

 

It is not possible for the Seller to guarantee the Buyer a specific delivery time, therefore the Seller does not arrange delivery for a specific time.

 

In the event of attempts to deliver in accordance with the rules agreed with the Buyer (e.g. leave at the reception, hand over to the buyer himself), the Seller will not be able to complete the delivery for reasons beyond his control (e.g. no person at the reception, reception closed, lack of presence at home and unsuccessful attempt telephone contact) and the Seller requests additional delivery to this or another address, it will be carried out for an additional fee of PLN 15 or PLN 20 (remote districts and outskirts) after setting new delivery hours.

 

  1. Payment for the order is made according to the choice made by the Buyer:

 

Transfer to the bank account number indicated by the Seller;

Via the Pay-U online payment platform;

The order is sent within the time specified by the Seller.

In the event of non-payment, the Seller has the right to suspend the execution of the order.

The purchased subject of the contract is sent to the Buyer by courier to the address indicated by the Buyer.

The products offered by the Seller are dedicated to healthy people. If the Buyer suffers from any chronic disease or other health condition, he or she should consult a doctor before placing an order. This also applies to pregnant and lactating women.

The products offered by the Seller may contain allergenic and allergic substances, all semi-finished products contained in the products are listed on the Seller's website at www.sunngin.com. The Buyer has full access to them, and therefore bears full responsibility when making a purchase from the Seller.

E-gift cards

  • Expiry: Our eGift cards have no expiry date and remain valid indefinitely after purchase.

  • Non-Exchangeable: E-Gift cards cannot be exchanged for cash or any other form of payment.

  • Personal Use: E-Gift cards are intended for personal use only and cannot be resold or transferred to another party.

  • Promotional Cards: Any promotional cards distributed by the company may have a specified validity period. These promotional cards are not available for purchase and are distributed at the sole discretion of the company.

  • By purchasing or using our eGift cards, you agree to abide by these terms and conditions. The company reserves the right to modify or update these terms at any time without prior notice. Please review our full terms and conditions for further details."

  • Electronic Form: E-Gift cards are delivered in electronic form and will be sent via email to the designated email address.

  1. Changes to orders

 

The Buyer has the right to cancel the order or change the product, date or place of delivery, provided that the declaration of will to cancel the order is delivered to the Seller no later than 5 business days before the delivery date, by 7:00 a.m. (e.g. if the delivery is to take place on Saturday, the order may be changed no later than on Monday by 7:00 a.m.), otherwise the declaration will not be considered effective. In the case of changes that are to apply on Monday, information about the change must be provided by Wednesday at 7:00 a.m. If information is submitted to the Seller at a later date than specified above, changing the order will unfortunately not be possible for technical reasons and the Buyer will be obliged to accept the delivery and cover the entire cost of the order.

The Seller confirms any changes to the order by sending an e-mail to the address provided by the Buyer.

In the event of a change in the form of a change in the place of delivery (e.g. to a place outside the delivery zone), a change in the type of product (for a product whose price is higher), excluding resignation from the diet during its duration (which will result in loss of entitlement to obtain a discount), The buyer is obliged to settle the amount due to the change.

If changes made by the Buyer result in an "overpayment" in relation to the original order, the Buyer has the option of settling the overpayment on the next order.

  1. Complaints

 

The customer is not able to withdraw from the contract due to the fact that the products offered have a short shelf life and are subject to rapid deterioration and destruction (Act on special conditions of consumer sales).

If the delivery item has a defect, the Buyer is obliged to report it to the Seller no later than 1 (one) day from the date of delivery of the order, under pain of losing the right to report the defect. In the notification, the buyer is obliged to specify the nature of the defect and the reason for filing the complaint.

In the event of receiving a notification of a defect, the Seller will respond to the notification immediately, but no later than within 7 (seven) days from the date of receipt.

If the defect report is deemed justified, the Seller will act towards the Buyer as follows:

The Seller will replace defective items with defect-free items.

Pursuant to Art. 3 points 1 point 3 of the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827), the provisions of this Act do not apply to the purchase of products offered by the Seller. Seller pursuant to Art. 558§1 of the Civil Code completely excludes liability towards customers for physical and legal defects (warranty).
